By accessing this website and completing any transaction via Pledgebox, you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and Hearthora LLC (the "Company").
1. Nature of the ProjectPYROX is a crowdfunding project. By submitting payment, you acknowledge that you are supporting a production process in progress, not making a retail purchase of an existing product. All funds are immediately committed to manufacturing, raw materials, and global logistics.
2. Finality of Transactions● No Cancellations: All payments made for shipping, taxes, duties, and add-on products are final and non-refundable.● No Refunds: We do not offer refunds or "change of mind" cancellations under any circumstances, as these funds are instantly allocated to third-party manufacturing and logistics contracts.
3. Shipping and Risk of Loss● Responsibility: Our legal responsibility ends once the product is handed over to the shipping carrier. Risk of loss and title for the product pass to you upon delivery to the carrier.● Address Accuracy: The user is solely responsible for providing a correct shipping address. Hearthora LLC is not liable for lost shipments due to incorrect data. Re-shipping costs will be charged to the user.● Import Duties: You are 100% responsible for any VAT, GST, or import duties required by your country’s authorities.
4. Force MajeureHearthora LLC shall not be liable for any delays or failure to perform resulting from causes outside its reasonable control, including but not limited to: acts of God, war, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, fuel, energy, labor, or materials.
5. Limitation of LiabilityTo the maximum extent permitted by law, the Company’s total liability shall not exceed the actual amount paid by the user. We are not liable for any indirect, special, or consequential damages arising from the use of the product.
6. Warranty and Replacements● Standard Warranty: All PYROX units include a 2-year limited warranty covering manufacturing defects from the date of delivery.● Extended Warranty: If you purchased the Extended Warranty Add-on, your coverage is extended by 1 additional year (3 years total).● Scope: This warranty is strictly limited to the repair or replacement of defective parts. It does not cover damage caused by misuse, unauthorized modifications, or normal wear and tear (including but not limited to cosmetic issues, battery degradation, or limescale buildup).● No Other Warranties: Except for the specific warranty periods mentioned above, the product is provided "as is" without any other express or implied warranties.
7. Dispute Resolution and Jurisdiction● Exclusive Venue: Any legal action or proceeding shall be resolved exclusively in the courts of Sheridan, Wyoming, USA.● Class Action Waiver: You agree to resolve any disputes individually and waive any right to participate in a class-action lawsuit or class-wide arbitration.
